EFF Battles Effort to Dismiss Surveillance Lawsuit

San Francisco - The U.S. 9th Circuit Court of Appeals announced today that it will hear the U.S. government's and AT&T's appeal of a district court's decision allowing the Electronic Frontier Foundation's (EFF's) case against AT&T to go forward. The lawsuit alleges that AT&T collaborated in the National Security Agency's (NSA's) illegal spying program. The 9th Circuit did not rule on the merits of the appeal.

In regards to the recent cases of developing, selling, stealing, and court battles over Native American land the following document explains the logic and the law, in clear to read wording

This is an exact quote from the Simcoe document of 1793 covering the protection of approximately 95,000 hectares.

"It is our royal will and pleasure that no transfer, alienation, conveyance, sale, gift, exchange, lease, property or possession shall at any time be had, made or given of the said district or territory of any part or parcel thereof by and of the said chiefs, warriors, women and people of the said Six Nations or body of people, person or persons whatsoever other than among themselves, the said chiefs, warriors, women and people of the said Six Nations, but that any such transfer, alienation, conveyance, sale, gift, exchange, lease or possession shall be null and void and of no affect whatever.

And that no person or persons shall possess or occupy the said district or territory or any part or parcel thereof by or under any pretense whatever under pain of severe displeasure. And that in case any person other than the chiefs, warriors, women and people of the said Six nations shall under pretense of any such title as aforesaid presume to possess or occupy the said district or territory or any part or parcel thereof that it shall and may be lawful for us, our heirs and successors at anytime hereafter to enter upon the lands so occupied and possessed by another person or persons other than the said chiefs, warriors, women and people of the Six Nations and them the said intruders thereof and there from, wholly do dispossess, evict and resume the same to
ourselves, our heirs and successors."

WASHINGTON - John Bolton's prospects for staying on as U.N. ambassador essentially died Thursday as Democrats and a pivotal Republican said they would continue to oppose his nomination.

It was another blow to President Bush, two days after Democrats triumphed in elections that will give them control of Congress next year. On Wednesday, Bush had announced that Defense Secretary Donald H. Rumsfeld, a polarizing figure and face of the Iraq war, would step down.

On Thursday, the White House resubmitted Bolton's nomination to the Senate, where the appointment has languished for more than a year. Bush appointed him to the job temporarily in August 2005 while Congress was in recess, an appointment that will expire when the Congress adjourns, no later than January. The United States has vetoed a U.N. Security Council draft resolution condemning Israel’s killing of civilians in the town of Beit Hanun in the Gaza Strip.

Washington has vetoed a draft on Israeli operations for the second time this year.

 

In the voting of a draft resolution that would condemn the Israeli attacks in Gaza Strip, and especially the one on Beit Hanun where 18 civilians were killed, 10 Security Council members supported the draft, whereas Japan, Denmark, Great Britain and Slovakia abstained.

 

Despite overwhelming support, the draft was not passed because of U.S. opposition.

 

U.S. Representative to the Security Council John Bolton claimed that the draft did not impartially reflect what was happening in Gaza and said that their objection was based on its unbalanced and biased content.

To hell with his Neocon agenda get the bum out of "our" UN position!

So this guy has committed -- without any question, this guy has committed war crimes, violations of the Geneva Conventions.

The president of the Center for Constitutional Rights, Michael Ratner, is heading to Germany today (11-9-06) to file a new case charging outgoing Defense Secretary Donald Rumsfeld with war crimes for authorizing torture at Guantanamo Bay.

This past September, a Canadian judge released the findings of a commission of inquiry that investigated the extraordinary rendition of Canadian Maher Arar to Syria by the United States.

Justice O'Connor concluded that "I am able to say categorically that there is no evidence to indicate that Arar has committed any offense ."

Now that the votes have been counted ....

How about we all get some health care and some education.....maybe some veterans benefits ....maybe some increase in the 'minimum' wage and how about  some affordable college tuitions......what the heck how about some campaign finance reform as well as cleaning up the dirty lobby money and corruption. And then last but not least how about some peace and harmony in this world with effort made to end this war.

Ya some real good things happened today!

But just prior to hearing that I had just drove under an overpass on the 84 freeway leading into Portland

.....and seen hanging a "big home made simple sign" which said:

JAIL BUSH

I could tell there was energy in the air .....

my phone rings ....a friend tells me Rummy's Canned at 1:00

I have been feeling exhilarated all day

How Bad Can Life Be?

When a person takes all they can

When it seems that life has exhausted all hope or help

Maybe then Death, is the answer.

When it is relief from all that pain.

When the cry in the night last for days and days and no one can feel or help you in your time of need.

When the love is gone and all that is left is tears that are hollow.

When nobody gives a rats ass about your life and death seems it is your only choice for your destiny

I wish I could of helped ...... but my desires, are beyond my control.

My heart is sad. I hear your cry in the night.

On my lunch today as I walked past a friend who did an "air guitar" move as if playing .... and whispered/sung "row Jimmy row" ...which is a Grateful Dead song that is an all-around-favorite and a good rainy day song, anyway it put a smile on my face and left the peaceful song running through my head as I stepped out onto the porch

I was briskly met by the wind and soft rain and with in 30 seconds I came upon this tree branch with beautiful bright red berries hanging down. They were colorful and beautiful the picture is a fraction of the vibrancy in real life

So, I took this picture and kept walking

Three minutes latter as I was walking down the sidewalk, I looked down the street about 2 blocks from my work front porch

I walk a block closer and I see police cars and fire trucks, and the road is blocked off with caution tape

I could see someone one in the street covered with a yellow tarp

I thought they may of been hit by a car

But latter back at work I heard that the person jumped from a tall building and had committed suicide, I was told it was an older lady.

As I look back at these berries I realize that their life is so simple and free

And now for the person who jumped

They to are free .....

I wish I could of loved her ...maybe I could of helped, maybe things would of been different.

It is a sad afternoon in the city I live in

I named my picture Berry Dead

The picture doesn't make me feel good, like it did when I first seen it

Hours later from my workplace roof where I am working I have a view of where she jumped from

I look over and say a short prayer for her

I can see a guy working on the very window 14 stories up, he doesn't show up in my picture 

I take the picture (below) from my camera phone and go back to work wondering if I should leave some flowers where I seen her in the street today

3 days later on Nov 10 - I post this here small update and add a picture at the bottom.

There is still small shards of glass in the street. The street is busy as usual. And its been raining for days. In the same way I remember it wqs that day.

A friend helped me gather a bouquet of flowers from a display that was being removed at our work. On my lunch hour I left them in the rain by the tree by where she lay.

I wish here soul peace I feel her pain and try to understand her cry

....it affects my feelings when I walk down this street. The rain makes things seem all right for now.

 The picture below looks as pretty as my Dead Berry picture. I think its beautiful

Conditions With Hunger Strikes

HOUSTON, Nov. 7 2006 — Likening themselves to prisoners at Abu Ghraib and Guantánamo Bay, a dozen inmates on death row in Texas have staged hunger strikes over the last month to protest what they call abusive conditions, including 23 hours a day of isolation in their cells.

The Texas Department of Criminal Justice said that the first inmates began refusing food Oct. 8 and that two were still on hunger strikes in the Polunsky prison unit in Livingston, about 45 miles east of the execution unit in Huntsville. The Polunsky Unit houses death-row inmates until their executions. As of Tuesday, one inmate had missed 35 consecutive meals and one 17 meals, but no one has yet been force-fed, said a department spokeswoman, Michelle Lyons.

Two other prisoners who had not eaten since Oct. 8 began taking food Oct. 27 and Nov. 4, Ms. Lyons said, and others abandoned their protests after a short time.
