Dear NRDC BioGems Defender,

I'm writing to report a big stride in our campaign to protect whales and other marine mammals from mid-frequency naval sonar.

Two weeks ago, NRDC attorneys raced to court to block the U.S. Navy from unleashing a barrage of ear-splitting sonar into the waters off Hawaii as part of a massive military training exercise. Whales exposed to mid-frequency sonar have repeatedly stranded and died on beaches around the world -- but the Navy refused to adopt even common-sense measures during peacetime exercises to help protect marine life from this deadly threat.

In an infuriating attempt to avoid our lawsuit, the Navy took the unprecedented step -- on the eve of the Fourth of July weekend -- of declaring itself exempt from the primary U.S. law that requires measures to protect marine mammals. But the court sided with us and found that the Navy's planned sonar use violated a second key environmental law as well, noting that NRDC had submitted "considerable convincing scientific evidence" of the dangers of sonar to marine life.

The judge prohibited the Navy from going forward with its sonar use as planned and ordered the Navy to sit down with NRDC and decide on a set of protective measures to be put in place during the month-long exercise. In the settlement reached last Friday after days of tough negotiation with our attorneys, the Navy will be required to create a sonar-free buffer zone around the newly established Northwestern Hawaiian Islands Marine National Monument, as well as significantly improve its monitoring of marine mammals during sonar drills and implement other important safeguards.

This is an important victory, but much more needs to be done to protect whales and other marine life from high-intensity sonar, especially in biologically rich waters. You see lucky me, my fellow reader, Amy Goodman was at the fair to speak for a few minutes I used my handy cam-phone to snap the above cheesy quality photo of Amy, amongst those greener than green trees of ole Oregon country, where she spent the next 40 minutes re-interpreting the importance of alternative media news sources. She bragged, and rightly so, about the increase in demand for www.Democracy Now.com all-over the "US and foreign countries" She spoke of the elaborate passing of "the-news-stories" as updated as quickly as possible and then translated into numerous languages ...then ...quickly posted/uploaded onto the Internet...and now lately her web info is hitting Radio and TV ....shows like KBOO, NPR...and PBS are all asking for daily feeds now. Their program is growing. She mentioned a new station in Southern Oregon just starting up to host the program. People are wanting real news, not corporate fed White House-fed Bullshit SPIN
She was excited and Wow! "talk about saying YOU GO GIRL!" this lady was intelligent, and full of activistic & vigor. Pro-Uncensored Media and Pro-Truth for All the People
Hey a real journalist!

She spoke on the need to get the True-Real News Out... to the people…through alternative sources, blogs, newspapers, speakers, etc. She basically painted the True-but-Ugly picture of our LACK-OF-MEDIA that we have today, and the Dogs Of War (my choice of words) that are lying to us through the Media that they now own. Amy said the The Media we the people have lost control over today, are now the lap dogs for the Pentagon and The White House! *insert GO GIRL HERE*

Amy also spoke of the need "to be aware" of what is going on in our news and what we are being told.
I didn’t take notes but she mentioned many of the same rants and concerns that I and Ben Waiting have brought up here in the ZEBRA3 Report and on Joe-Anybody.com
She mentioned lot-O-stuff that my dear hearted and Faithful Z3 readers are already Up-2-date and informed about.

As I told a friend who didn't get to hear Amy speak (but was camping with me at the fair).......I said to him...
"She basically spoke of everything that I "Joe-Anybody" & Readers already know about. In fact, I didn't learn one new thing from her!! But I myself read about this stuff all day long and also while in my sleep and the fact she was out-n-about speaking to a crowd of 200 art loving fair-going open minded people (yes Hippies too, of course!)was good news spreading activism. And all these people were gleaning and being encouraged about alternative media. A chance to get inspired!

Now of course "yes" I am sure there was a dozen or two [or three] that were already inspired activists and fully aware "already" ...but the idea is to...... as any ACTIVIST knows....


"YA Gotta Get The Word Out”.....and that was what Amy was doing. GOOD JOB .....I loved it!

She opened her short lecture with a cute feel-good-Fair-related comment of thanks, saying
"wow! That was the first time I got introduced by a fairy or butterfly" (That said because the girl who introduced her was dressed up in typical Fair Gear of "fairy wings" which you see allot of when you are down here amongst the costumed, the painted, (yes some nakid too) and then the average tye-dye joe anybody who always dresses up as his typically everyday scary self with no shower or hair brush for 5 days...--> *.....RUN) but it WAS cool to see Amy Goodman relaxed in the woods and talking to us all 'to get involved and to be wise to the Spin'
She said she would be wearing her own “fairy wings” latter in the evening as the fair closes to the public at 7pm and the behind the scenes vendors, and fair workers get to play through the night, the rest of us all go to our campgrounds …..mine was a mile away through the woods, I really didn't mind it either. Get your wings Amy……!!!

So back to the story…
As Amy finished her lecture I had to hurry and get to the main stage 10 MINS away to here a favorite band of mine "The Zen Tricksters" But I think the The JGB (Jerry Garcia Band) who played the day before was a better show. As I digress, I wanted to stay and here her answer questions but ahhhhhhh time was short. I noticed that she did address the problems with the Media SINCE Sept 11.....but really gave no hint that the busman and his goons allowed this to happen. Now the guy who spoke Before Amy Goodman at the fair on the stage, which by the way I forgot to tell you was labeled "The Front Porch" And...no it didn’t look like a front porch it just is sort-of-close to the entrance!
...Well this guy speaking, flat out said "the bush administration allowed this 911 attack to Fuckin happen" *you can insert Go Girl for him here!....


Ya he was right all right
...I have been told Amy wont address the issue of the 911Bush-Knew and stays clear of it on her program [shame too]!
HA ...But do you know why?

......because when you grasp the idea that our government allowed this your Life Will Change.....and you will feel SICK

he also came right out and attacked the Christian philosophy of believing in a higher power (which I disagreed with him on)which for all I can see is that the reason people are doing this today it seems to me is....

...as he was just doing ...I figured it is because MANY MANY Christians get so brain locked into their RELIGION they cant see the glass full of POISON KOOL-AID they are drinking from our Leaders laddle in a “political sense” They have been given them their drink on a daily media spinned bassis
Let me repeat that again.
The MANY MANY Christians get so wrapped and locked into the RELIGIOUS thought process they cant see they are drinking POISON "kool-aid" from the Media, Their Government, and it is Terror Induced Phony Bullshit Manipulations that they 'fall for' or swallow. And/or as even in some cases believe that George Bush is some kind of CHRISTIAN LEADER leading them as a Christian would??? (by the way that is a lie GB is no Christian by far!!) That is way I see allot of attacks on the general Christians attitude come from some onthe Left. They see these non-thinking following Christians believing the spin and helping lead the world down an ingnorant path of kool-aid-drunk sheeple.
I do suspect it comes from this concept ..that the religion is in the way of seeing the …
Truth of Today being FIXED and their Religion keeps them blind in a niave-obediant way the Lies from the Daily Media.
Some quickly blame the Religion or the Christian belief ……I my self think that those victims have drank some of the readyily available "POISON - NEOCON Kool-Aid" and now are suckered in Faith-n-All.

Well folks its that time of year

So my car is about packed and I head up to the local "cheap gas station" to Fill-er-Up for my 2-1/2 hour journey to Eugene Ore. As the attendant takes my request and starts to put the nozzle into my tank he says .....
"Will that be cash or credit?"

I say "If I pay in cash will that make me a TERRoR Suspect?"
I look him straight in the eye (but with a big smile.)

He nods his head........
from side to side
I think he may of tried to smile?
'He did get a good look at me' as I paid him the 26 dollars and drove off.......
wow! that gas was cheap ...2.79 a gallon.
That was weird.
But thought provoking.
What if that was the way it wassssss?

Credit!! or you could be a "suspect" for using cash, just like on the air planes nowadays!.........

But - not me today,
America....
I was smiling, I had a full tank of gas, new tires and no work for the nexy 10 days in a row......

AMY GOODMAN: This is former Guantanamo prisoner, Moazzam Begg.

MOAZZAM BEGG: I was held next to Salim Hamdan in Guantanamo for a period of two months and he often told me about how hard they were working together with Charles Swift in trying to obtain his rights. But we all remained skeptical because we felt that it was the United States government, in one sense, trying to feel good about itself in offering these types of laws and telling the detainees that at least you have the ability to defend yourself in this way, which wasn't true at all.

AMY GOODMAN: The Supreme Court ruling was hailed by human rights groups, legal experts, and other former prisoners. In a statement the free British detainee, Shafiq Rasul, who spent two years at Guantanamo without charge said, quote, “This is another step in our collective efforts to see that those we left behind are treated fairly under international law.” President Bush took questions from reporters shortly after the verdict was announced. He was at the White House in a joint news appearance with the Japanese Prime Minister Koizumi.

REPORTER: You’ve said that you wanted to close the prison at Guantanamo Bay, but you were waiting for the Supreme Court decision that came out today. Do you intend now to close the Guantanamo Bay quickly? And how do you deal with the suspects that you said were too dangerous to be released or sent home?

PRESIDENT GEORGE W. BUSH: Yeah, I -- thank you for the question on a court ruling that literally came out in the midst of my meeting with the prime minister. And so, I haven’t had a chance to fully review the findings of the Supreme Court. I, one, assure you that we take them very seriously. Two, that to the extent that there is latitude to work with the Congress to determine whether or not the military tribunals will be an avenue in which to give people their day in court, we will do so.

The American people need to know that this ruling, as I understand it, won't cause killers to be put out on the street. In other words, there's not a -- it was a drive-by briefing on the way here. I was told that this was not going to be the case. At any rate, we will seriously look at the findings, obviously. And one thing I'm not going to do, though, is I'm not going to jeopardize the safety of the American people. People have got to understand that. I understand we're in a war on terror, that these people were picked up off of a battlefield, and I will protect the people and, at the same time, conform with the findings of the Supreme Court.

REPORTER: Do you think the prison will close?

PRESIDENT GEORGE W. BUSH: Well, I haven't had a chance to fully review what the court said, Terry. I wish I had, and I could have given you a better answer. As I say, we take the findings seriously. And, again, as I understand it -- now, please don't hold me to this -- that there is a way forward with military tribunals in working with the United States Congress. As I understand, certain senators have already been out expressing their desire to address what the Supreme Court found, and we will work with the Congress. I want to find a way forward.

In other words, I have told the people that I would like for there to be a way to return people from Guantanamo to their home countries, but some of them -- people need to be tried in our courts. And that's -- the Hamdan decision was the way forward for that part of my statement, and, again, I would like to review the case. And we are. We've got people looking at it right now to determine how we can work with Congress if that's available to solve the problem.

FIRST - The U.S. Supreme Court ruled Thursday that President George W. Bush overstepped his authority in ordering military war crimes trials for Guantanamo Bay detainees, saying in a strong rebuke that the trials were illegal under U.S. and international law.
The court declared 5-3 that the trials for 10 foreign terror suspects violate U.S. military law and the Geneva conventions
It was a broad defeat for the U.S. government, which two years ago suffered a similar loss when the high court held the president lacked authority to seize and detain terrorism suspects and indefinitely deny them access to courts or lawyers.

The ruling raises major questions about the legal status of the approximately 450 men still being held at the U.S. military prison in Cuba and exactly how, when and where the administration might pursue the charges against them.

It seems likely to further fuel international criticism of the U.S. administration, including many U.S. allies, for its handling of the terror war detainees at Guantanamo in Cuba, Abu Ghraib in Iraq and elsewhere.

White House counselor Dan Bartlett said the administration's task now is mostly technical - trying to determine how to design military tribunals that would pass muster under the decision. Republican senators said they would co-operate.(Full article --> HERE! <--)

on Thursday unanimously approved an international treaty that would ban states from abducting perceived enemies and hiding them in secret prisons or killing them

The International Convention for the Protection of All Persons from Enforced Disappearance would require states to keep registers of detainees and tell their families the truth about their disappearance, as well as paying compensation.

In this article it is absurd that the UN has to create a law to cover the USA sneaky ass way we have been skirting the intention or design of the laws. We (the US) act like a two-bit backwood lawyer that is just one snakey step away from a prison term. Shadowy loophole exploitations of International Human Rights. Flying prisoner to far away secret prisons in countries that have horrible Human Rights Abuse Records. Can you believe that Congressional offices lately are trying to install new software that blocks email from their constituents?

If the citizens are sending from a wide range of nonprofit organization websites that help you contact your congress person through their site, then this new software would block your email message.

This new technology is already in use by more than 30 Representatives. It requires you to answer a "logic puzzle" question before you can submit a comment. This is designed to limit communications to only those constituents who go directly to the lawmaker's own website to send a message. Now I go directly to their sites anyway, BUT I also send them letters or emails from the website of political action groups that I read about or belong to.
Now what is IRONIC or should I say is SADISTIC is the stifling of the mass amounts of people who are communicating with their Representatives and then getting blocked because they used a web service that is making it easy to contact them.
It is almost as if they are not "LISTENING TO THEIR CONSTITUTES BECAUSE THEY ARE BANNING TOGETHER"

I would further say that is considered by me to be MORONIC to block the messages from large groups or any size of group that wants to send a message. Now I did see where there was some stupid group that sent bricks to all the Senators for some (stupid) cause, that escapes me at the moment. And there is the occasional Larry Flint type who sends a copy of HUSTLER to every congressman.....but then maybe he too has a message or info that he wants to share with his Representative.

This following paragraph is taken straight from the petition, and sums up exactly what I see as the problem:

This attempt to differentiate among constituent messages--accepting only unorganized communications but blocking communications where individuals are working together to deliver a strong message--raise questions about the infringement of my constitutional right to organize and petition my government. I enjoy using the Internet to participate quickly and effectively in decisions that affect me and my family. I don't want to go back in time to the days when people had to fill the halls of Congress with paper postcards or attend mass events to get your attention. The Internet has made political action more accessible to me, and therefore makes this country more democratic.

Lammert, told lawmakers the bureau was still surveying agents around the U.S. but so far has found no "systemic" use of data brokers by the FBI seeking telephone records or other information without warrants or subpoenas. Lammert, the bureau's deputy general counsel for its investigative law branch, told a congressional panel: "There are compelling reasons for the government to believe that these operations violate federal law." Now this type of obvious mining or searching over records by law enforcement that we traditionally have been used to seeing enacted, has been abided by for the most part within the boundaries of the constitution and the law and its intention. As mentioned in this article in the above quote, the concept that if illegal means was acquired to make a bust, the fact that it was illegally obtained thwarted the arrest and the case for prosecution was jeopardized. What we are seeing now, is a blatant and new bold/sneaky rise in this current administration of abuse and disrespect for this Country’s Law and for the rules. These rules are there for these very reasons that we put them there for. Yet these current day Police State Thugs are stomping on all of our constitutional rights and then claiming they Have The Right To Do So.

This activity of breaking or going above the law under the guise that “we are stopping terrorism” needs to stop. Nobody is above the Law.

What are they smoking?

Everyone of these Data record keepers in the picture above took the 5th ammendment. As they mum-up their lips to prevent their "Sinking Ship"
