We woke up this morning early on  9-15-08

Turned on C-Span radio.

And heard Brian Lamb quoting Ralph Nader.

From years ago.

With Ralph warning about extravagance, recklessness, and excessive compensation on Wall Street.

Warning years ago about the undue influence of Fannie and Freddie on Democrats and Republicans alike.

Warning about the failure of our government to protect small investors.

Throughout his career, Nader has strong been a strong advocate for due diligence.

For protecting shareholder rights.

For prudential regulation.

And strict oversight of the markets.

While the Democrats and Republicans have bent to the whims of their corporate masters and Wall Street's bottom line imperatives.

Nader has been steadfast in his advocacy for safety, regulation, and protecting the little guy.

Unfortunately for the nation and for investors, his warnings have gone largely unheeded.

On this momentous Monday, as we watch the fallout from the failed policies, greed and extravagance of the corporate political class unfold, we make this simple note.

Due diligence, prudential regulation, and strict oversight of the markets -- Nader-style -- would have gone a long way to averting the disaster currently hitting Wall Street.

Instead, it was short-term fast and dirty profits, muzzled politicians, and throw caution to the wind.

And so now, the American people are learning the hard way about the consequences of a reckless corporate dominated political economy.

But thanks to your hard work, we are in a position to give America a choice in November.

CNBC is calling it, "The biggest shakeup in the history of the US financial system." The country is in a "once-in-a century" financial crisis, former Federal Reserve chairman Alan Greenspan said on ABC's "This Week" on Sunday. The New York Times reported late Sunday that Bank of America has reached a $44 billion deal to buy troubled investment firm Merrill Lynch.
 
Another firm wasn't so lucky: Unable to find a buyer over the weekend, 158-year-old investment bank Lehman Brothers filed for bankruptcy Monday morning. Lehman's liquidation will mark the largest collapse of a Wall Street bank since Drexel Burnham Lambert folded in the wake of the junk bond scandal almost two decades ago.
The problems don't end there. "We will see other major financial firms fail," Greenspan said on "This Week." Giant insurance company American International Group (A.I.G.) asked the Federal Reserve for $40 billion, "without which the company may have only days to survive," according to the Times. Washington Mutual, too, may be in trouble, after its shares plummeted late last week and Moody's Investor Service downgraded the bank's debt to "junk" status.
 
And in Europe, a Swiss newspaper reported that Swiss bank UBS will have to take another $5 billion in write-downs.We'll see what happens over the course of the day on Monday, but A.I.G., at least, seems to be in serious trouble. Adam Bakhtiar, a CNBC analyst, called Sunday's events a "tidal wave of horrific news." James K. Galbraith, an economist and contributing writer for Mother Jones, wrote in an email that while he has "a pretty good record on attacking Wall Street," his "schadenfreude is very much under control at the moment":The world will not be a better place with two free-standing investment banks—Goldman [Sachs] and Morgan [Stanley]—and a half-dozen major commercial banks, if that, running everything. Further, there is a risk that the unraveling will become disorderly and out of control from this point, as assets hit the market in fire sales and do not find takers.
 
This will affect pension funds and greatly compound the collapse of the wealth position of the middle class.... The collapse of Wall Street will hit Main Street like Ike hit Houston.
So how do we get out of this crisis? Well, the prime mover of all of these problems is the collapse of the housing bubble in the United States. "There's no question that this is in the process of outstripping anything I've seen, and it still is not resolved and it still has a way to go," Greenspan said Sunday. "And indeed, it will continue to be a corrosive force until the price of homes in the United States stabilizes."
The collapse of Lehman and the broadening crisis will undoubtedly be topic "A" for the presidential campaigns this week.
Barack Obama and John McCain want to lead this country.
How do they plan to respond to Monday morning's news?

I went to the PDX airport with 100 people to greet Mustafa. Lots of media showed up but it seems non of the major four networks ran the story on TV news. Another person and I carried a 10 foot banner that read "Welcome to America, we vow to stop bombing children" When the media totally ignored it, I folded it in half and gave it to some children. They stood holding it "stop bombing children" A shocking image Americans will never consider.

I was at the Airport. At the end, when media were packing up I spoke up for the first time and simply said "thanks to the media for showing up". The crowd cheered. Sadly I came home and watched most TV stations and saw nothing. KOIN showed dragon boats, a car crash, car vandalism. KGW, a fire, a giant lizard, a martial arts guy dies. KATU grass fire, teen driving age, ford recall, car windows smashed. KPTV feces in a garden, Hurricane IKE, teen robber gets 8 years in jail. Kudos to the Oregonian. To the others... MLK said "there comes a time when silence is betrayal"

Well-wishers turn out Tuesday at Portland International Airport to welcome Mustafa Abed, 5, and his father, Ahmed Mohammed (in tan shirt). Mustafa was 2 when he lost his leg and suffered severe internal injuries during a U.S. missile attack in Iraq. Portlanders raised money to bring the child to Oregon for the medical care and prosthetic he needs.
When the air raid began, Nidhal Aswad gripped her child in her arms and ran, but she couldn't escape the nightmare that her boy's world would become.

A U.S. missile struck a nearby building, knocking the two to the street in Fallujah, western Iraq. When Aswad regained consciousness, she heard her 2-year-old, Mustafa Ahmed Abed, screaming. Shrapnel had severed his bowel, left leg and most of his hip.

That terrible day in November 2004, Aswad couldn't have imagined that nearly four years later, strangers from the same country that fired that missile would donate money and medical expertise to help her child heal. She couldn't have dreamed, in other words, of the scene that unfolded Tuesday at Portland International Airport, after her husband and son touched down.

"Imagine if this was your child and a community reached forward to do this," Maxine Fookson said Tuesday. "Your heart would swell."

Fookson and her husband, Ned Rosch, are ringleaders in the effort to bring Mustafa, now 5, to Portland. Medical teams at Shriners and Doernbecher children's hospitals expect to fit the boy with a prosthetic leg and explore whether they can improve his abdominal wounds.

He will be the fourth child from Iraq or Afghanistan to be treated at Portland Shriners Hospital for Children since the war began.

Fookson and Rosch had their radio tuned to 90.7 FM, KBOO, one day last October when they heard an interview with Cole Miller, a California screenwriter who in 2002 co-founded No More Victims. The nonprofit, nonsectarian, humanitarian group advocates for peace and brings war-injured Iraqi children to the United States for medical care they can't get in their own struggling country.

The interview hit the Southeast Portland couple right where their passions live: Fookson, 55, is a pediatric nurse practitioner with the Multnomah County Health Department. Rosch, 58, is director of the Northwest Osteopathic Medical Foundation. Both are active in Portland's peace movement.

Fookson said she remembers thinking: "It was our tax dollars that bought the bombs. Why isn't it our volunteer dollars that do the healing?"

They called Miller at No More Victims and started a Portland chapter, one of more than 20 nationwide.

"Portland is a city with a very large heart and wonderful pediatric resources," Fookson and Rosch wrote in a November appeal to colleagues, friends and acquaintances. "We'd like to put these into action by banding together. ... We are reaching out for your help."

Responses poured in.

Churches passed collection plates for No More Victims. Neighbors raised money at potlucks and poetry readings. The metro area's Muslim community offered help. Franklin High School students spent the summer stitching a welcome quilt for Mustafa.
The group raised about $20,000 and will continue fundraising, Fookson said.

While No More Victims arranges donated medical care, the group estimates it costs $17,000 to $25,000 to bring an Iraqi child and one of their parents, usually the father, to the United States. Because fathers typically are the family wage earner, the nonprofit also provides Iraqi families a stipend while the father is away.

In addition to his mother, Mustafa has a younger brother and sister at home.

When he's not hospitalized, Mustafa and his father will live at Ronald McDonald House.

Until they examine him this week and next, doctors won't know what surgeries Mustafa needs or how long he might have to stay in Portland. It could be four to six months, Fookson said.

Doctors know the boy uses a colostomy bag but don't know the extent of his internal injuries; medical records from the war zone are more scant than the medical care available there.

Because he lost his leg so high on his hip, fitting him with a prosthetic will be challenging. Kay Weber, a spokeswoman, said difficult cases such as Mustafa's are Shriners' specialty; the nonprofit hospital, which provides free care to needy children, has the region's largest pediatric orthopedic medical staff.

About 100 Oregonians bearing balloons, flowers and warm smiles turned out at PDX on Tuesday to greet Mustafa and his father, Ahmed Mohammed. Among the welcoming party, of course, was Fookson, who sounded nearly breathless with anticipation, her hopes high for the child she called "a little ambassador of peace."

On September 3, 2008, George Norey the host of Coast to Coast which is heard in the US on over 500 Stations and through out the world, interviewed Steve Qualye.

The bottom line is that Russia has given NATO 21 DAYS to Exit the Black Sea.

Could this be the start of something big?

Could this postpone the USA Election?

There is so much more I could write but I will let the video stand for itself.

This is a serious warning and could create all kinds of problems world wide.

The US Government will be "technically" Bankrupt as of September 30th, so we will see.

A US Navy flagship carrying humanitarian aid yesterday steamed into a Georgian port where Russian troops are still stationed, stoking tensions once again in the tinderbox Caucasus region.

A previous trip by US warships was cancelled at the last minute a week ago amid fears that an armed stand-off could intensify in the Black Sea port of Poti.

The arrival of the USS Mount Whitney, flagship of the 6th Fleet in the Mediterranean, came as Moscow accused Dick Cheney, the hawkish US Vice-President, of stoking tensions during a visit to Tbilisi this week. After meeting President Saakashvili, Mr Cheney vowed to bring Georgia into the Nato alliance. Russia sees such moves as Western encroachment on its traditional sphere of influence.

Russia's leaders have accused previous US warships that docked at the port of Batumi, to the south, of delivering weapons to re-arm the smashed Georgian military — charges that Washington denied.

While Russia again questioned the deployment of what it described as "the number one ship of its type in the US Navy" in the Black Sea, it said that it planned no military action in response. The Russian Army has kept a small component of soldiers in Poti, where Georgian officials accuse them of looting port authority buildings.

"Naval ships of that class can hardly deliver a large amount of aid," said Andrei Nesterenko, a Russian Foreign Ministry spokesman. "Such ships have a hold for keeping provisions for the crew and items needed for sailing. How many tonnes of aid can a ship of that type deliver?"

He said that the presence of US warships could contravene international conventions governing shipping in the Black Sea, and in particular restrictions on the entry of naval ships from countries that do not share a Black Sea coastline. The small Russian garrison in Poti would pose no military threat to a vessel like the Mount Whitney, but the proximity of two hostile forces in such a fraught environment set the political temperature rising again in the Caucasus a month after Russia's five-day war with Georgia.

Moscow, which followed up its crushing military defeat of Georgia by unilaterally recognising two of its breakaway provinces, South Ossetia and Abkhazia, was angry that Mr Cheney still insisted on Georgia's entrance into the Atlantic alliance — something several key Nato members oppose. "The new promises to Tbilisi relating to the speedy membership of Nato strengthen the Saakashvili regime's dangerous feeling of impunity and encourages its dangerous ambitions," said Mr Nesterenko.

Visiting Kiev, the Ukrainian capital yesterday, Mr Cheney kept up his tough anti-Russian rhetoric when he urged Ukraine's squabbling pro-Western leaders to unite in the face of threats to the country's security. He met President Yushchenko and Yuliya Tymoshenko, the Prime Minister, and told them that Ukraine's best hope was to be "united with other democracies".

Mr Yushchenko has accused his former Orange Revolution ally of siding with Russia in the war with Georgia, an allegation she denies. The split led to the collapse of Ukraine's coalition Government on Tuesday.

After endorsing Georgia's application, Mr Cheney said that the US was also committed to Ukraine's membership of Nato. Konstantin Kosachyov, head of the foreign affairs committee in Russia's lower house, accused Mr Cheney of forging an "anti-Russian axis".

energy from ocean waves that he claims would cost 5% of what coal

He set up a proto-type in Ghana and, initially, claims to have found
many potential investors. However, suddenly problems started to pop
up. The investors, originally extremely enthusiastic, started to
back off. He was offered bribes in order to quit. Finally, he began
to be harassed by Ghanaian police and mercenaries.

He contacted me in hopes of getting protection. I told him to come
to Japan. He told me he was not allowed to leave the country. He
said they had taken parts from his prototype. I said I would see
what I could do. Before I could do anything, yesterday I received a
disturbing set of phone calls from a very scared sounding Mr.
Nystrom. "They tried to kill me three times today," he screamed into
the phone. Then I lost contact with him, and his phone has been
switched off.

In his last call, he asked me to make his technology public. So,
here below is a description of his technology. Would people please
pass it on and would as many people, in a tribute to a man who has
probably been killed by mercenaries hired by the oil industry, and
make sure that prototypes are developed.

Wavereaper™ the Technology.

 

Waves work in a constant movement up and down, forth and back, and we can with the WaveReaper™, a simple mechanical device take advantage of this in a cheap way.

 

As we said, the wave move up and down, but most generators, rotate around an axle, and the wave size varies a lot, and creates problems, when you want to utilize the energy content of them. The current technologies regarding wave energy today, is very costly, which brings that can’t compete with other ways of making energy.

 

Another factor, water, and generators, yes almost any technology, is having problem, when it comes to the oceans salt water without more expensive design and material. Water can leak inside equipment and ruin electrical circuits, and must therefore be safeguarded against corrosion, and in those cases it is under water, against leakage, and pressure. Also water-depth, and the special environment, which crave divers, and other expensive equipment, has made wave energy costly.

With other words, underwater technology is not cheap, with these problems to solve, which means high costs, and therefore more expensive energy for the consumer. This is not what we would like, so it’s needed to solve the wave generation concept, to go around these problems. And the solution is simple, we can use basic items, as wire, plastic barrels, one way bearings, pulley, an axle, flywheel and generator.

 

That is the main components, in what up to day, is the cheapest wave energy technology in the world. It can even be built in wood or by choice bicycle parts! This is very good, in countries which have limited access to expensive metals, and heavy machining tools. Most of the parts in a generator, except wiring, can be made of wood or plastics.

 We will use a set of plastic barrels as boys, cost is low, and Pvc isn't affected by salty ocean water. The barrels are placed near shore or longer out in deeper water, depending on amount of energy needed in particular wave plant. 

 

Each barrel has a lifting force of approx 100 Kg. A wire is connected to the barrel, which goes to a brass block on the bottom, which is weighted down, with a big stone, and connected to another wire. The location of choice is the main parameter for the size of the barrels, smaller waves, smaller barrels, and vice verse. Wave heights can possible catch range from 2 foot and up.

The number of barrels, can be larger, but i think, for practical reasons, a number of 100 on each plant, would be good, and reasonable, this amount, can in the shore line version, give up to 500 kW of energy, or even more if special locations, and in a plant that covers 100 meter of shoreline, that makes it, 3 mw per kilometer shoreline. 

 

The barrels is on 2 meters distance from each other, and connected to the on mainland placed WaveReaper generator, via the “power transmitting wire” it is also is connected with a thinner wire, between them, so, if the power wire should break, the barrels, don’t get to drift away, in the sea. This will also even out the possibility that the barrels, would smash into each other, when the sea is rougher.

 

The lifting capacity is also setting a maximum power input into the device, since if it is to large/fast waves, the barrels would not lift more than it can, and forces is kept within the range, chosen when constructing the WaveReaper plant.

Example, number of barrels in each row 10, and rows 10, the plant would be 20 x 20 meters of area, 400m2, and will have 100 connected wires, which transfer the mechanical energy, to the generator. This type of plants, give 100 to 300 kW every hour, which generates profits, of 6500 to 20 000 dollars of revenue monthly, building cost of the plant is estimated to 20 000 dollars only. This give that the WaveReaper earns itself, in a few months, instead of years.

Reverse Half-Pipes makes it possible to haul gear without divers. 

I have chosen to use cheap materials only, in this demonstration, because the need to bring down production costs, and make it possible to build this type of wave generation device, any where in the world, and with local materials, as car parts etc, which doesn't needs to be imported. Other materials could of course be used, and the schematics for its design of course, be different. Simple is better, it is said, and fewer parts, and bearings, will bring lower cost of building, and also repair.

We can here see energy content in waves, The numbers means kW per hour, and meters of wave. South America, 97 kW per meter of wave, for example, that means, a Wavereaper™ device, which is 100 meters broad, would generate 9.7 mw, cost would be around 1200 000 Dollar, for that device. However, the revenue would be over 400 000 dollars monthly with current energy price.

This is a simple schematic, showing buoys, wire and one-way bearing, connected together.In case of storm and rough waves, it is a problem, for all wave energy constructions, however, the Wavereaper™, has a built in safety feature in its construction, that would avoid damage on the equipment, its due to the max lifting force of the barrels, since the will sink under the surface, if the force is to great. this will make the Wavereaper™ possible to work in any weather, however it should be constructed, to take advantage, of the medium wave, that is present at all time, for best cost benefit of the plant.

The wire is connected to a chain in the end, witch works on a gearwheel sitting on a one-way bearing, mounted on an axle. This translates the pulling force of the wire, to an circular movement which is good for cheap generators. The wire is for this case 4 mm stainless steel, which give a lifting ability of approx 300 Kg before it brakes. Also plastic can be used as Pvc band, which today is commonly used for packaging goods on pallets, this type of Pvc band has high strength, and is also light, and cost-effective, of course the UV light from the sun is affecting it in the long run, but the part that is in the water, should be somewhat guarded from the UV rays.

 

Flywheels is also mounted on the axle, to collect, even out/store the momentum which is produced by the lifting barrel, this will even out and, smooth the turning's of the axle, to the generator, which is driven by a pulley, who will give it correct rpm. A simple brake, which can never wear down, is also planned, in those cases, constant current generators, or a special electronical device is not used.

 

 

 

Pipes mounted on the wire, which means we can haul in and out the device, without leaving the shoreline. With this configuration, if one set of barrels malfunction, only 10% of the plants output is lost, it can be hauled in to the shore and serviced, with ease, and without complicated offshore operations. When the wire coming to the generator housing, a chain is mounted to the wire, which drive the Gear wheel, and the one way bearing, which makes the chain draw, when the waves raises the barrel, but let it spin freely back, when the wave height is going down again, also a small weight is connected to the chain, to make it even out slack of the wire. A flywheel is mounted, and a pulley drives the generator, evenly.

One-way bearing, with pulley and wire, with bigger loads, chain and gearwheel, is an option. One-way bearings can be seen in ex. bicycles, the rotate freely in one direction, but in the other direction, they grip, and transfer force, this is used in the Wave reaper, and makes it simple, and cost effective. The waves up and down, movement is translated to rotating movement, suited for a generator, of choice.

 

 

 

Benefits of the One-way bearing.

The barrels will of course jump up and down in random patterns; this will add to an even movement of the generator axle, and its flywheel, as soon as a wave has energy to contribute, it will transmit its force to the wire, and to the axle. The flywheel is storing the momentum gained from the waves temporarily. 

 

Because of its design, the WaveReaper, is always self adjusting regarding wave height, and tidal shifts, and higher or lower water levels due to shifting weather patterns, no adjustment needed, the Wavereaper™ is always balancing itself out, to optimal level in the ocean.

Sitting outside the Black Dog cafe in lower St. Paul late Tuesday morning, a lanky kid in dreadlocks and a black Bob Marley T-shirt stopped, asked me for a light, and sat down next to me. It was drizzly and gray, and eerily quiet. The night before, nearly 300 people had been arrested by Minnesota police in a sweeping display of brute force. Among them were journalist Amy Goodman and two Democracy Now! producers, both of whom were physically assaulted. With helicopters overheard and the National Guard out, it felt like a city under siege.

I asked the guy if he lived in St. Paul. "Yeah." It turned out he lives next door, in the building where I've been staying, an artist's co-op on Broadway Street. I was about to ask him what he thought about the scene here when he sort of laughed and said, "Yeah, you know -- I was just arrested."

At around 9:45 that morning, John, 20, was walking home from the bank a few blocks away when he spotted what he thought was a police riot club -- a ubiquitous weapon on the streets here. "It was right off of West 7th Street in, like, a planter; I checked it out but it ended up being a broomstick." He put it down and kept walking, when suddenly he was surrounded by police officers -- "three squad for sure, maybe four" -- one of whom was a woman. "She was like, 'Get on your stomach or I'm gonna tase you!'" He asked them what he had done, but they wouldn't say. Instead, they asked him leading questions about other people they'd just arrested. "They said, 'so, who was in the white van you were associated with?" "I was like, white van? I don't know what you're talking about."

John said he hasn't done any anti-war organizing -- "I'd like to" -- but since the arrival of the RNC and the protesters against it, he has been checking out the scene around town. "Yesterday I was just cruising around. I was in the Funk the War march -- they had this huge Gandhi statue and a globe …" But despite the mostly peaceful protests, when it comes to security, "it's been crazy." He showed me videos he'd taken on his phone while he skated around, lines of cops in riot gear -- "There was a bunch of people getting maced over there" -- and shots of the buses and unmarked minivans the police have used to detain people and take them away.

I asked him if he had been read his rights. "No, they didn't read me my Miranda rights at all. ... They cuffed me, and when I complained to one one guy about the cuffs being too tight, he was like, 'Oh yeah? Well, let me tighten that up for you.'"

While he kept asking why they were arresting him, John did not resist -- "I was really cooperative; I didn't want to be held" -- but he did remember something he had been given at one of the marches. "Finally I pulled this out," he said, showing me a slip of paper that read, "ACLU Important Contact Information." "Yeah, you should hold onto that," one of the cops told him.

"They held me right down over there," he said, pointing north. "It's, like, the St. Paul police station." They confiscated and searched his belongings but forgot his cell phone in his pocket. "They put me in a cell that had snot and blood all over the wall," he told me, pulling out his phone and showing me footage of the stained white walls. He was given no phone call.

John was held there for about 15 minutes before they had him talk to anyone; two plainclothes investigators interrogated him, asking him what he knew about the demonstrations against the RNC, some of which have led to rioting and destruction of property. "They tried to get me to admit to some involvement ... but I told them that I've just met people and been to peaceful marches." Before leading him back to his cell, they gave him a 612 number to call. "They asked me to report anything I knew."

Googling the number later led me to a FBI homepage, Minneapolis division.

After he was questioned, John was put back in his cell. He was never told how long they might hold him. "They didn't even tell me what I was being detained for until they opened the door." I asked him what. "Like, suspicion of planting something ... anything that could be used as a weapon, I guess." There was no documentation.

As we were talking, we saw a caravan of unmarked vans led by a police car pull a U-turn in the middle of the intersection at the corner. One of the cars turned on its siren and they sped off.

By then, a group of neighbors were hanging out near us. John greeted them and said, "I was just arrested." How was it? "Awesome," he laughed. "Best day of my life."

"So, you were picking up sticks?" one guy joked, "What were you thinking?"

"I thought I was free!" John laughed.

I asked him what he was up to now. He said he wanted to go to a concert taking place at the Capitol. Dead Prez was scheduled to perform. At the station, he said, "They told me if I got picked up again that I would probably be locked up for the remainder of the RNC. ... They were like, 'You probably shouldn't go outside, because if the same cops see you they're not gonna be happy.'"

He was dropped off across the street by one of the officers. ("He was nice enough to give me a ride back, so that was cool.")

I asked him if he would be relieved when the RNC was over. "Yeah, most definitely. I wasn't looking forward to it coming. … I feel like I've been profiled since day one." Plus, it's been slow at the Italian restaurant where he works. "At first, at my work, they were like, yeah, this is a good opportunity to get some good business, but instead we're closing early … because most of (the RNC delegates) have rented out places and they get free drinks; they don't really care about supporting local businesses since they don't live here. They don't give a shit."

A woman who also lives in the building next door sat down next to us. "I have to say," she said, "this city I live in has so much egg on its face. I'm embarrassed to say I live here. It's just tragic."

"The vibe's like they came in and took over our whole city," John said. "It's like we don't have rights. Like we don't even live here."

* The under-pressure jail vigil supported by Coldsnap at the Ramsey County Jail (Grove & Lafayette)
* The heavy riot police (bearing the misnamed 'non lethal' array of weapons including rubber bullets, gas canisters and concussion grenades) are guarding the Ripple Effect concert, Coldsnap estimates 120 riot police. There appear to be snipers on the MnDOT building - which is still less hazardous than trusting Carol Molnau to keep our bridges up. * Something is going on around Mears Park, Coldsnap reported @ 3:55 that 60-80 riot police at 8th & Wacouta Commons. Breaking @ 5 PM from one source: "a March for People's Lives is going to take place tonight from Mears Park to the Xcel. Already at least 500 protesters and just as many police. Riot, swat and bicycle."

Before the march began, speakers spoke on a stage on the lawn in front of the capital. BEAVERTON, Ore. (AP) - Beaverton police say a 27-year-old man has been charged with interception of communication because he audio recorded a confrontation between an officer and a man being arrested at a bowling alley this week.

State law allows audio material to be recorded only if one of the parties is aware the recording is taking place.

Authorities say neither the officer nor the man being arrested knew that Ho Xent Vang of Aloha was recording their words on a cell phone.

Police said Friday that Vang also had video of the arrest, but that's permissible.
