Judge orders negotiations halted in contentious aboriginal land dispute August 08, 2006 - 3:39 pm
By: 680News staff and Canadian Press Cayuga, Ont. - A judge in Cayuga, Ontario says his orders over a contested tract of land have been ``blatantly disregarded.'' Justice David Marshall says there must be no more negotiation over the land between governments and the six nations until his orders are followed. Marshall is angry native protesters haven't been removed from the land at nearby Caledonia that has been occupied since February. Negotiations aimed at resolving a bitter land occupation that has, at times, turned violent must be suspended until aboriginal protesters move off the contested property, an Ontario court judge ruled Tuesday. The ``lawlessness'' that has characterized the occupation of a housing development in the southwestern Ontario community of Caledonia must end before talks with the province and the federal government can move forward, said Superior Court Justice David Marshall. "It is common knowledge that the people of Caledonia, after five months of occupation, have seen security in their town replaced by lawlessness, protesters in battle fatigues, police officers in riot in gear,'' said Marshall. When asked if the province would abide by the judge's ruling, Premier Dalton McGuinty replied ``it's the kind of thing that we're going to want take some time to carefully consider.'' "I would appeal for people to be calm,'' the premier added. Significant progress has been made in the dispute, including a deal that saw aboriginals remove a contentious highway barricade, said McGuinty. "Let's not lose ground as a result of this ruling.'' Relations between aboriginal protesters and their non-aboriginal neighbours have been marked by violence since the occupation began in February. Over the weekend, residents and protesters clashed yet again, as rocks and golf balls were thrown at each other. On Tuesday, a shouting match erupted outside court between more than a dozen protesters and non-aboriginal residents, calling each other ``squatter'' and ``terrorist'' and blaming each other for recent violence. Clyde Powless, a spokesman for the occupiers, said they planned to meet Tuesday night to discuss their next move. "As far as the judge's orders, we're still digesting that,'' he said. ``We don't like to make rash decisions.'' At the site of the occupation, protesters feared that the ruling will cause police to move in and try to remove them. Joe, who declined to give his last name, said if provincial police come, he'll be ``ready.'' "The only way they're going to get me off this land is if they drag my dead body off,'' he said. Marshall issued his order after holding several hearings to discover why his previous orders to remove aboriginal protesters have been, in his words, ``blatantly disregarded.'' "The court has been patient, but the court cannot turn a blind eye to blatant contempt of the court's lawful order,'' he said. Six Nations protesters have occupied the Douglas Creek Estates housing development since the end of February, claiming it was wrongly taken from them by the Crown more than 200 years ago. Marshall issued a court order in March to have the protesters removed by police and to have barricades lifted on nearby railway tracks. Police did raid the occupied site on April 20, and lawyers for the Ministry of the Attorney General have argued that Marshall's orders have been carried out, noting police have laid 53 charges against 28 people. Marshall took the unusual step of calling representatives from the federal government, the province, police and aboriginals into court to explain their actions. Another day is upon us and I had to write my Congressmen again! Now with no suprise to me, it is over the very same issue that the Supreme Court just recently reprimanded the White House Renegades that they couldn't do in the first place with: Hamdan v. Rumsfeld which struck down the President's unfair military tribunals at Guantanamo. Now these Sneaky DOGS OF WAR ...try pushing their --> --> "White House Tribunal Proposal" through. --> Well not if Joe Anybody is yelling as loud as he can to do something to prevent this ......heck here is my letter I sent my two Senators, I used the Human Rights website to get some of my information and then put it in my own mix of feelings and words to it all. I write you today with encouragement not to go back-wards with our Human Rights Policies. I write to encourage you not to support the recent Presidents proposal, which would deprive detainees of fundamental legal rights and go against the values in which our nation stands for. As you are aware, the recent Hamdan v. Rumsfeld ruling, in which the Supreme Court struck down the military commissions, established by the Bush administration in 2001, was a step in the right direction. We need to continue on that moral track and help turn our country back into a country that is respected in the world and at here at home. We need to abide by the law and respect the rights for all humans. These are Human beings we are talking about. The US should be acting civilized and proud of our moral standing, but I write today because I am worried. The fact that the White House has recently responded by asking Congress to bless a system that is even worse than the one the Supreme Court rejected is a blatant continued push that is not my viewpoint of how the United States should behave. These administration's proposed rules would allow coerced confessions, withhold classified evidence from defendants, and deny defendants the right to be present at trial. This is unacceptable - and illegal. Moreover, the system would extend far beyond Guantanamo and apply to anyone - even people inside the United States - that the President labels an "unlawful enemy combatant." Our country can step in the positive direction of Human Respect and show the world and me, that we are humane. For starters, use the widely respected courts-martial system to try war crimes suspects. In addition, by adopting the Uniform Code of Military Justice as the starting framework, we can carry out efficient prosecutions and meet this country's human rights obligations. We do not need to step back-wards in time. This is so important that you help our country in these very horrific trying circumstances. I would not need to bother you today but it seems the never-ending wave of disregard for civil and human rights never seizes and now another important issue rest again, on your shoulder. Please consider this a letter from a constituent that is asking you to consider that the Uniform Code of Military Justice as helping do just what it says it is, military justices. Most important my letter is urging you, to Resist White House Tribunal Proposal, which is taking us back-wards, and is wrong for our country. How Hard Is It To Get On The Ballot?

This article illustrates, how rigged the duopoly and control of getting on the ballot really is. It mentions what I have and as well as many others have said and or have been screaming about. That the running for office of President, is so hard to do unless you are a part of the Two Party System. It is rigged to prevent and it continues to "skewer to protect" the mighty two party choice. If you call that being a choice! With interest, I think to my self “duhhhhhh” when I was reading the first part of this article. Hell as an avid Ralph Nader supporter, I know this debacle all so very well. In addition, I lived through Oregon’s messy stinking red-tape bullshit as signatures were tossed out or analyzed to the point of no return, and insinuating accusations and comments were tossed around like as if the devil himself was trying to get on the ballot. Well actually truthfully, the Devil was on the Ballot and even “cheated his way to be the current president we have now”. As I digress, these recounts of mine, of the Oregon election petition problems, and paying signature gatherers is an interesting topic, and rife with abuse and 'neglect of not allowing a true democratic process to exists" and affording the potential to allow abuse with out ethics and honor. Actually this whole topic has been neglected and swept under the shadow of the “vote for the two party” spin... and has been keeping the “good men (and ladies) down” for so long that not many will understand, that this is a very controlled crooked system. There needs to be a better answer on this because, what we are doing is not good enough, it needs to have some consistent order on a federal level. It should be not used as a tool to keep opponents of the duopoly from getting on the ballot. But as a tool to regulate and yet allow the freedom to run for president and the choices in multiple opponents. For we the voters should not be "out of reach" to the point we have “no choice” Believe you me the difference between The Republican and The Democrat party …..is sadly enough not much difference and this article will shed a little light on this process to keep the mighty as always, ruling with laws that keep power in their hands as they steal and manipulate the way to challenge or contest any possible challenger. Interesting too is that these little tweaks of the constitution that has been adjusted for their benefit and security, are like a sore or wound that will never heal. The first step to get the process rectified I think is “get the masses to realize we need a better (honest) way to get a third party on the ballot. We need to allow more choices. We need real Democracy not Duopoly”We need to do that in a real bad way! In all fairness it needs to be looked into now! Is the fact that people were paid to get a 3rd party on the ballot not right? Even if they get on the ballot, it leaves them little money to wage a general election campaign, they said."Unfortunately it's becoming more and more common," said Thom Marti, an Adams County farmer who is the party's petition coordinator. "Some of the states have such restrictive ballot access, it's really beyond the capability of a small party."In an average year, Marti said, the state party can get the 25,000 or so signatures it needs with volunteers alone. To get the 67,070 required this year, paid circulators for U.S. Senate candidate Carl Romanelli's campaign got $2 per valid signature. The party also recruited members and others to canvass "for more or less pocket money" to add to volunteer efforts, Marti said.States have tried to regulate the activity with varying degrees of success, but a total ban on paying petition circulators was struck down by the U.S. Supreme Court in 1988. In 2004, the Libertarian Party in Pennsylvania got almost half its signatures for statewide office from a paid campaign, but decided against it this year, in part because of the high signature requirement, said Chuck Moulton, the state party's vice chairman. The party will run statewide candidates only if a court overturns the high signature requirement, he said."There are a lot of states it's impossible to get on the ballot without the use of paid signature gatherers," Moulton said. The Pennsylvania signature threshold is especially high this year because it is calculated based on the number of votes cast for the largest vote-getter in the last statewide election. This year's requirement is based on the record 3.4 million votes by which Bob Casey was elected state treasurer in 2004.Romanelli has acknowledged that probably more than half the roughly $100,000 spent to collect his signatures came from Republican donors, including some who also gave money to Sen. Rick Santorum.Casey, Santorum's Democratic opponent, could lose votes to the Green Party due to Romanelli's support for abortion rights. Casey's campaign accused Republicans of trying to steal the election."Ideally, signature gatherers should be volunteers," said state Democratic Party spokesman Abe Amoros. He cited Ralph Nader's 2004 presidential bid as an example of the problems that can come with paid signature-gatherers.Nader was thrown off the ballot in several states, including Pennsylvania, where a contractor promised $100 to $200 a day to petition circulators. Many homeless people took the jobs in Philadelphia, where dozens of duplicate signatures were found. A state judge called the petitions "rife with forgeries."JSM Inc., which was hired for Romanelli's effort, also worked on Nader's efforts in a number of states; a listed phone number for the firm could not be found.Many states that allow citizen initiatives, which Pennsylvania does not, have tried to regulate the practice of paying petition circulators. Jennie Drage Bowser, of the National Conference of State Legislatures, said the concern is that, "if signature gatherers are motivated to gather more signatures because they'll earn more money, they might also be motivated to use dishonest tactics."One Arkansas initiative was tossed off the ballot because someone had gone though the phone book and signed names "in alphabetical order, right down the page," Bowser said. In Oregon, evidence was submitted that circulators of various initiatives got together and had "signing parties," where they signed each other's petitions, she said.Michael Arno, the owner of a consulting firm that says it has collected signatures to qualify nearly 500 ballot initiatives in 20 states, said the Nader campaign managed its own drive and was unaware of the pitfalls. He said experienced firms can sniff out problems."We do find people that forge. We hand them over to the authorities to be prosecuted, and I wish they'd prosecute them more vigorously," Arno said. "Probably 99 percent of petition gatherers out there are decent, honorable people."State governments have tried to step in.Oregon bans paying initiative circulators by the signature, but courts have rejected similar regulations in other states. Several states require circulators to disclose whether they are paid or volunteers.Arno called regulation efforts ineffective. Banning per-signature payments, for example, breeds sloppiness and padding of hours without reducing the number of problem signatures, he said."When I pay people by the signature, if they do something wrong I can unpay them by the signature," he said.

The Spanish-language army facility based in Fort Benning, Georgia, was responsible for helping to educate such military men as Panamanian dictator and convicted drug trafficker Manuel Noriega, the late Argentine junta leader imprisoned for human rights abuses Leopoldo Galtieri, and Salvadoran right-wing militia leader Maj. Roberto D'Aubuisson. Despite adding a "human rights" element to its curriculum in recent years, the school has engendered so much suspicion and hostility that it was dubbed the School of Assassins.

Ironically, a few days later the U.S. Congress voted to continue supporting military intervention in Latin America by rejecting an amendment put forth by Rep. McGovern which would have excluded funding for the infamous School of the Americas (SOA) as part of the annual Foreign Operations Appropriations bill. Now Group B has their friends and family and even police or authorities who were effected by the bad thing done by Group A, with this done to them they take revenge. Group B claims they were offended and retaliate by dropping huge bombs and rockets all over Group A land and killing say like 22 children for example as in my posted recent News Flash above. Then Group B destroys the whole town and kill hundreds more after they destroy the whole city...... they say they were not the ones to start it and they have done NO WRONG......... and get this, THE UNITED STATES BACKS UP GROUP B ....AND IS THE ONE WHO IS SUPPLYING GROUP B THE WEAPONS TO FIRE AT GROUP A wow now both sides are fighting and killing civillians on both sides ...but a nin-rod would be smarter than Isreal's way of handling this...the USA isnt much brighter It makes no sense and it is wrong to support any group in this situtation......but certainly with a tad bit of common sense and decency ...you don't kill a village because of a dozen bad men in it. ...Unless you are either sick in the head or a mass murderer!

Dear Senators, I urge you to please not appoint John Bolton into the UN as a Representative of the USA I am ashamed and embarrassed for his concerns regarding Human Rights, Torture, War, and his lack of respect for the UN in general. As Sen. Joseph Biden Jr. said, "Mr. Bolton's performance at the U.N. only confirms my conviction that he's the wrong person for this job." And indeed he is the wrong person. I affirm that quote passionately. He is not helping our Nation work with other countries to my satisfaction by a long shot. He has secrets and skeletons that he refuses to put out on the table. As in the use of National Security Agency for spying on not terrorist, but citizens I was upset about him being into this temporary position in the first place, as I remember how after repeated failed attempts by GOP leaders to grant Bolton Senate approval, Bush last Aug, used his executive power to sidestep Congress and temporarily assign Bolton to the job. That was a low blow, and a sad choice. We need a Respectable, Forthright, Honest, Law abiding and Geneva Honoring, no hidden agendas, and willing to work with the 190 other Countries that participate. I encourage you to send a message to the world we need good leadership and a change in leadership For as I said in my second sentence, I am ashamed and embarrassed for his concerns regarding Human Right, Torture, and War and respecting the purpose of the UN He is negligently changing for the worse our involvement in the UN and our UN policies and the way in which we are perceived, by the whole world.
